“Rent an App”  Application Terms of Use Generally The company ‘MEDIAWORX IKE – VAT Number: 800954774 – Reg. Number: 145676406000 “which provides marketing &  application  services (hereinafter the “Company”) has developed the “Rent an App”  application (hereinafter’ the “application”), which allows consumers to use ordering services (delivery). The software is compatible with iOS & Android mobile devices. The use of the Application implies full and complete acceptance of these terms. If the user does not agree with the terms of the Application, must not proceed to use the Application The Company may however modify at any time without notice these Terms but undertakes to update this document for any modification or addition. Users should be informed of any changes to these terms and if they continue to use the application, it is presumed to have accepted the modifications. The Company reserves the right to discontinue providing the Application either individually or in total at any time and without the obligation to notify users. A few words about the application: The application is accessible from both mobile iOS & Android devices. This is an application which allows consumers to use ordering services (delivery). RENT AN APP  is the most easy way to use delivery services and can be installed on any type Tablet or Smartphone. The use of the Application not charges users a fee only to any costs associated with receiving / sending data within the application. For data consumption the user is charged according to the then current price list for the use of data of the provider (charge data usage). As part of the Application, users, if they wish, can receive Push notifications in case of special offers or other promotions. Permitted Use Using the application the user accepts the Terms of Use and undertakes to indemnify the Company against claims of third parties which would result from a violation of these Terms. The user is required to use this app responsibly and exercising reasonable judgment of a prudent average person. The use of the Application is allowed only for legitimate purposes and in no case for damage to other persons. Specifically prohibited: The use of the Application in a way that infringes copyright, related rights, patents, products, or service marks, trade names, trade secrets or other intellectual property rights or personality of third parties and the right personality The user of the application is bound to make use of in accordance with the law, their morality, these terms, as well as the Google Play terms of service and the App Store terms. It also undertakes not to commit any acts / omissions that may cause damage / dysfunction, affect or endanger the provision of services or cause damage to the owner company of this application. Trademarks / Copyrights / Intellectual Property The trademarks, logos, characters and service marks (collectively “Intellectual Property Rights”) displayed on this application are owned by the Company or used by it under license. Unauthorized sale, reproduction, republication, posting (uploading), receive data (downloading), distribution, posting, presentation, transfer, create derivative works of the Application or the Intellectual Property Rights, including reverse engineering (or the attempted disclosure of the source code of the Application) are prohibited. You may download the application only for this, specified use, provided first that will keep all references to copyrights and trademarks, as well as any other information contained in this material and also agree to be bound by and comply with any additional copyright notice, information or restrictions, as will be contained in any such material that will have access. Use of Intellectual Property Rights and the Application are governed by these Terms of Use and the Terms of Use for the Company Websites and Applications. The Company will protect the maximum permissible statutory level of rights of Intellectual Property, including criminal prosecution. Privacy The user data (Name, Address, e-mail, phone number) will be held and processed by the Company solely for the provision of application services. The Company does not provide any kind of security for access, operation and possible options of the Application nor that the services will be continuous and error-free, that defects will be corrected, the application and the services provided must meet set specifications or performance criteria or quality or that the application does not carry viruses or other harmful components.
